1) What these terms cover
These terms apply when you submit, claim, edit or manage a business listing (an “Item”) for publication in the MotoKind directory on motokind.co.uk (the “Directory”).
2) Who may submit
You must be 18+ and have authority to represent the business or lawful permission to submit its details.
3) Your submission
You agree that all information (text, images, logos, categories, contact details, opening hours, prices, services, brands, accessibility notes, social links and any other data) is accurate, lawful, up-to-date and not misleading. You will promptly update details that change.
4) Moderation & publication
All submissions are reviewed. We may approve, request changes, or decline at our discretion. We may edit for clarity, length, formatting, spelling, and to fit our taxonomy. Publication does not constitute endorsement by us.
5) Changes, takedown and suspension
You can request edits at any time. We may unpublish, suspend or remove a listing (for example, if information appears inaccurate, receives complaints, or breaches these terms or our guidelines).
6) Prohibited content
No unlawful, defamatory, obscene, discriminatory, infringing, or harmful content; no third-party personal data without consent; no misleading claims (e.g., safety ratings) or unauthorised use of logos or trademarks.
7) Intellectual property & licence
You retain ownership of your content. You grant us a non-exclusive, worldwide, royalty-free licence (with the right to sublicense to our hosting and service providers) to use, reproduce, host, store, adapt for technical formatting, publicly display and distribute your listing content on the Directory and in materials that promote the Directory (e.g., category previews, social posts linking to your listing).
You warrant you have all rights and permissions (including model/property releases where required) and that use by us under this licence will not infringe third-party rights.
8) Reviews and feedback (if enabled)
We may allow user reviews. We can moderate or remove reviews that breach our guidelines. We are not responsible for user opinions.
9) Ordering, ranking and featured placement
The Directory may order or rank Items by relevance, location, category, recency, or other criteria. We may offer paid featured placement or boosts in future; featured status affects prominence but not our editorial independence.
10) Fees
Submitting a basic listing is currently free. If we introduce paid options (e.g., featured listings), we will display pricing and any additional terms at the point of purchase.
11) Data protection
Personal data submitted with your listing is processed in line with our Privacy & Cookies Policy. Do not include sensitive personal data. If you provide third-party personal data (e.g., a staff member’s email), you confirm you have their permission.
12) Disclaimers
The Directory is provided “as is.” We do not guarantee leads, traffic, availability, ranking, or specific outcomes. You are responsible for your business’s compliance, insurances and professional standards.
13) Liability
Nothing limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot legally be limited.
To the fullest extent permitted by law, we exclude all implied warranties and will not be liable for lost profits, revenue, goodwill, data, or indirect/consequential loss. Our total liability to you relating to the Directory is limited to the amount you paid us for paid listing services (if any) in the 12 months before the claim.
14) Indemnity
You agree to indemnify us for claims, damages, costs and expenses arising from your listing content, your breach of these terms, or your violation of third-party rights.
15) Termination
You may request removal of your listing at any time. Sections that by nature should survive (e.g., licences granted, liability limits, indemnity) will continue after removal.
16) Changes
We may update these terms from time to time. Changes apply from the date posted.
17) Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
